Credit Authorization & Consumer Report Disclosure

NEXTWAVE LOAN PROCESSING LLC ("we," "us," or "our") operates the NextWave: Cash Advance Now website and mobile application. We provide this Credit Authorization and Consumer Report Disclosure ("Disclosure") in compliance with the federal Fair Credit Reporting Act (FCRA), 15 U.S.C. § 1681 et seq., the Fair and Accurate Credit Transactions Act (FACTA), and applicable state laws governing consumer credit reports and the use of consumer information. This Disclosure explains your authorization for us and our partner lenders to obtain and use consumer reports and other information in connection with your loan request. By submitting a loan request through our website or mobile application, you acknowledge that you have read, understood, and agree to the terms set forth in this Disclosure.
1. Authorization to Obtain Consumer Reports and Credit Information
By submitting a loan request, you expressly authorize and consent to the following:
1.1 Credit Reports and Consumer Reports
You authorize NEXTWAVE LOAN PROCESSING LLC, our affiliates, and the third-party lenders in our network to obtain one or more consumer reports (including credit reports) about you from one or more consumer reporting agencies (credit bureaus), including but not limited to Equifax, Experian, and TransUnion, or any other consumer reporting agency that may have information about you. For purposes of this Disclosure, "consumer report" has the meaning set forth in Section 603(d) of the Fair Credit Reporting Act and includes any written, oral, or other communication of any information by a consumer reporting agency bearing on your creditworthiness, credit standing, credit capacity, character, general reputation, personal characteristics, or mode of living, which is used or expected to be used or collected in whole or in part for the purpose of serving as a factor in establishing your eligibility for credit or insurance to be used primarily for personal, family, or household purposes, or for employment purposes, or for other purposes authorized under Section 604 of the FCRA.
1.2 Permissible Purpose
You understand and acknowledge that the consumer reports and credit information will be obtained and used solely for a permissible purpose under the Fair Credit Reporting Act, including but not limited to: (a) in connection with a credit transaction involving you as the consumer and involving the extension of credit to, or review or collection of an account of, you; (b) for the purpose of evaluating your application for credit; (c) for the purpose of determining your eligibility for credit and the terms on which credit may be extended; and (d) for other legitimate business needs in connection with a transaction initiated by you. You represent that you are the individual who is the subject of the consumer report and that you have the legal capacity to provide this authorization.
1.3 Scope of Information
The consumer reports and credit information that may be obtained include, but are not limited to: your credit history; credit scores; payment history; outstanding debts and obligations; bankruptcies, judgments, and liens; employment history; income information; residence history; and any other information contained in or derived from consumer reports that is relevant to evaluating your creditworthiness and eligibility for credit. You authorize the consumer reporting agencies to compile and furnish such reports and information to us and to our partner lenders.
2. Authorization to Share Information with Third-Party Lenders
You expressly authorize and consent to the following:
2.1 Sharing of Application and Credit Information
You authorize us to share the information you provide in your loan application, together with any consumer reports, credit reports, credit scores, and other information we obtain about you (collectively, "Your Information"), with third-party lenders in our network. These lenders may use Your Information to: (a) evaluate your loan application; (b) determine your eligibility for credit; (c) determine the terms, conditions, and pricing of any credit offer; (d) verify your identity and prevent fraud; (e) comply with applicable laws and regulations; and (f) for other purposes related to the extension of credit. You understand that multiple lenders may receive Your Information and that each lender may obtain its own consumer reports and credit information about you. Each lender has its own privacy policy and information practices.
2.2 Ongoing Sharing
You authorize us to share Your Information with lenders not only at the time of your initial application but also on an ongoing basis, as we may add new lenders to our network or as lenders may request updated information to evaluate or service your account. This authorization remains in effect until you withdraw it in writing or until such time as we no longer maintain your application information in accordance with our data retention policies.
3. Authorization for Identity Verification and Fraud Prevention
You authorize us and our partner lenders to verify your identity and to take steps to prevent fraud. This may include:
- Obtaining and using information from identity verification services, data aggregators, and other third-party sources to verify that the information you provide is accurate and that you are who you claim to be.
- Comparing the information you provide with information from consumer reporting agencies and other databases.
- Using your Social Security number, date of birth, address, and other personal information for identity verification purposes.
- Sharing information with fraud prevention and identity verification service providers who may maintain their own databases and use your information in accordance with their own policies and applicable law.
You understand that providing false, inaccurate, or misleading information may result in denial of your application, termination of services, and may constitute a violation of federal and state law, including the federal laws prohibiting fraud in connection with credit applications.
4. Fair Credit Reporting Act Disclosures and Your Rights
Under the Fair Credit Reporting Act, you have certain rights regarding your consumer reports and the information contained therein. The following disclosures are provided in compliance with the FCRA:
4.1 Right to Know What Is in Your File
You have the right to know what information is in your file at the consumer reporting agencies. You may request and obtain a free copy of your credit report from each of the nationwide consumer reporting agencies (Equifax, Experian, and TransUnion) once every twelve (12) months. You may request your free annual credit report by visiting www.annualcreditreport.com or by calling 1-877-322-8228. You may also be entitled to additional free reports in certain circumstances, such as when you have been denied credit, insurance, or employment based on information in your report; when you are unemployed and plan to seek employment; when you receive public assistance; or when you have reason to believe your file contains inaccurate information due to fraud.
4.2 Right to Dispute Inaccurate or Incomplete Information
If you believe that any information in your consumer report is inaccurate or incomplete, you have the right to dispute that information directly with the consumer reporting agency. The consumer reporting agency must investigate your dispute and correct or delete any inaccurate, incomplete, or unverifiable information, generally within thirty (30) days. You may also dispute inaccurate information with the company that furnished the information to the consumer reporting agency. The Federal Trade Commission and the Consumer Financial Protection Bureau provide information about your rights and how to dispute inaccurate information. 4.3 Right to Know Who Has Accessed Your Report
You have the right to know who has received your consumer report. Each consumer reporting agency must provide you with a list of all entities that have requested your report within the past year (or the past two years for employment-related requests), when you request such information.
4.4 Right to Limit Prescreened Offers
You have the right to opt out of receiving prescreened offers of credit and insurance. Prescreened offers are based on information in your consumer report indicating that you meet certain criteria. You may opt out by calling 1-888-5-OPT-OUT (1-888-567-8688) or visiting www.optoutprescreen.com. The opt-out request is permanent until you ask to opt back in.
4.5 Right to a Fair and Accurate Report
Consumer reporting agencies must follow reasonable procedures to ensure that the information in your file is accurate and that it is used only for permissible purposes. If a consumer reporting agency, furnisher, or user of consumer reports violates the FCRA, you may have the right to bring a lawsuit in federal or state court.
4.6 Adverse Action Notice
If a lender takes adverse action (such as denying your application for credit) based in whole or in part on information in a consumer report, the lender must provide you with an adverse action notice. The adverse action notice will include: (a) the name, address, and telephone number of the consumer reporting agency that furnished the report; (b) a statement that the consumer reporting agency did not make the decision and cannot tell you why the adverse action was taken; (c) a statement of your right to obtain a free copy of your consumer report from the consumer reporting agency within sixty (60) days; and (d) a statement of your right to dispute the accuracy or completeness of any information in the report. Because we are a loan processing company and not a lender, we do not make credit decisions. Any adverse action will be communicated to you by the lender that made the decision. If you receive an adverse action notice from a lender, we encourage you to contact that lender directly and to obtain a copy of your consumer report to review the information upon which the decision was based.
5. State-Specific Disclosures
Depending on your state of residence, you may have additional rights under state law regarding consumer reports and the use of your information. The following state-specific disclosures apply where applicable:
5.1 California
If you are a California resident, you may have additional rights under the California Consumer Credit Reporting Agencies Act (Cal. Civ. Code § 1785.1 et seq.) and the California Financial Information Privacy Act. You have the right to request a copy of your credit report from each consumer reporting agency. You may also have the right to know the nature and substance of information in your file. California law may impose additional requirements on users of consumer reports. 5.2 New York
If you are a New York resident, you may have additional rights under the New York Fair Credit Reporting Act (N.Y. Gen. Bus. Law § 380 et seq.). New York law requires that consumers be informed of their right to obtain a copy of their credit report and to dispute inaccurate information. You may contact the New York State Department of Financial Services for more information about your rights.
5.3 Minnesota

5.4 Oklahoma
If you are an Oklahoma resident, you have the right to obtain a written disclosure of the nature and scope of the consumer report requested. You may contact us to request such disclosure.
5.5 Other States
Residents of other states may have additional rights under their respective state laws. We encourage you to review the consumer protection laws of your state and to contact us if you have questions about your rights.
6. Withdrawal of Authorization
You may withdraw your authorization for us to obtain consumer reports and to share your information with third-party lenders at any time by contacting us in writing. To withdraw your authorization:

Please include your full name, date of birth, and the email address or phone number associated with your application so we can identify your request. Withdrawal of your authorization will not affect the legality of any consumer reports obtained or information shared before we received and processed your withdrawal. After we process your withdrawal, we will cease obtaining new consumer reports and sharing your information with new lenders. However, information that has already been shared with lenders may remain in their systems in accordance with their respective privacy policies and applicable law. Withdrawal of authorization may result in our inability to process your loan request or to connect you with lenders, and may result in the withdrawal or denial of any pending loan offers.
7. Electronic Signature and Consent
By submitting a loan request through our website or mobile application, you are providing your electronic signature and consent to this Credit Authorization and Consumer Report Disclosure. Your electronic signature has the same legal effect as a handwritten signature. You represent that you have read and understood this Disclosure, that you are the individual who is the subject of the consumer report, that you have the legal capacity to provide this authorization, and that all information you provide is true, accurate, and complete. You acknowledge that you have had the opportunity to request a paper copy of this Disclosure and that you consent to receive this Disclosure electronically. 8. No Obligation to Extend Credit
This authorization does not create any obligation on the part of NEXTWAVE LOAN PROCESSING LLC or any third-party lender to extend credit to you. We are a loan processing company and do not make credit decisions or lend money. The decision to extend credit, and the terms and conditions of any credit offer, are made solely by the third-party lenders. Submitting a loan request and providing this authorization does not guarantee that you will receive a loan offer or that any loan will be funded.
9. Retention of Information
We and our partner lenders may retain the information obtained pursuant to this authorization in accordance with our respective record retention policies and applicable federal and state laws, including the Fair Credit Reporting Act and regulations promulgated thereunder. Consumer reporting agencies may retain information in your file for varying periods depending on the type of information and applicable law. For example, most negative information may be reported for seven (7) years, and bankruptcies may be reported for ten (10) years. You may contact the consumer reporting agencies for more information about their retention practices.
10. Changes to This Disclosure
We may update this Credit Authorization and Consumer Report Disclosure from time to time to reflect changes in our practices, changes in applicable law, or for other reasons. We will post the updated Disclosure on this page and update the "Last Updated" date. Material changes may be communicated to you via email or through a prominent notice on our website. Your continued use of our services or submission of a new loan request after such changes constitutes acceptance of the updated Disclosure. If you do not agree to the updated Disclosure, you must not submit a loan request and you may withdraw your authorization as described in Section 6 above.
11. Severability
If any provision of this Disclosure is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of this Disclosure, and this Disclosure shall be construed as if such invalid, illegal, or unenforceable provision had never been contained herein.
12. Governing Law
This Disclosure shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. To the extent that federal law applies, including the Fair Credit Reporting Act, such federal law shall govern. Any dispute arising out of or relating to this Disclosure or the subject matter hereof shall be subject to the dispute resolution provisions set forth in our Terms of Use.
